1. Acceptance of Terms
By accessing or using profunc, including the website, VS Code extension, and any related paid or hosted features (collectively, the "Services"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Services.
2. License Grant
profunc may include both free and paid functionality. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or commercial purposes.
Pro features, when available, are subject to additional subscription terms as outlined below.
3. Pro Features & Subscriptions
3.1 Pro Access
Certain features of profunc may require a paid subscription ("Pro Features"). These features are clearly marked within the Services. Pro Features may include, but are not limited to:
- Hosted AI assistance and model-backed guidance
- API test and profiling workflows
- Unlimited run history and investigation data
- Other paid capabilities described at purchase or in-product
3.2 Billing
Pro subscriptions are billed on a recurring basis (monthly or annually, as selected). You authorize us to charge your payment method for all subscription fees, taxes, and applicable charges. All fees are non-refundable except where required by applicable law or where we expressly state otherwise at the time of purchase.
3.3 Cancellation
You may cancel your Pro subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to Pro Features until the end of the paid term.
3.4 Refund Policy
We do not currently offer a general or discretionary refund policy for Pro subscriptions. Because profunc is still in an early stage, we encourage users to evaluate the product through the free version before purchasing Pro.
As the product and our support operations mature, we may introduce a formal refund policy in the future. Nothing in these Terms limits any non-waivable rights you may have under applicable law.
4. User Responsibilities
You agree to:
- Use the Services in compliance with all applicable laws and regulations
- Not reverse engineer, decompile, or attempt to extract the source code of Pro Features
- Not share your Pro account credentials with others
- Not use the Services for any malicious, harmful, or illegal purposes
- Ensure your OpenAI API key (if used) is kept secure and confidential
5. OpenAI API Integration
profunc integrates with OpenAI's API for AI-powered features. By using these features:
- You acknowledge that your code data may be sent to OpenAI for processing
- You are responsible for complying with OpenAI's Terms of Service and Usage Policies
- You are responsible for any costs incurred from your OpenAI API usage
- We are not liable for OpenAI's service availability or data handling practices
6. Intellectual Property
The Services, including the extension, website, design, features, and branding, are owned by profunc and protected by copyright, trademark, and other intellectual property laws. Your license to use the Services does not grant you any ownership rights.
7. Data and Privacy
Your use of the Services is also governed by our Privacy Policy. By using profunc, you consent to the data collection and processing practices described therein.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROFUNC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. We may notify users of significant changes through the website, the Services, or email. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
11. Termination
We may suspend or terminate your access to the Services, including Pro Features, if you violate these Terms or engage in fraudulent or abusive behavior. Upon termination, your license to use the Services ceases immediately.
12. Governing Law
These Terms are governed by and construed in accordance with the laws applicable in the jurisdiction where profunc operates, without regard to conflict of law provisions. Any disputes arising from these Terms will be resolved in the courts that have proper jurisdiction in that location, unless applicable law requires otherwise.
